Terms & Conditions

Please read these terms and conditions carefully. When you make a booking, you accept on behalf of your party the terms of these booking conditions. It is your responsibility to ensure that all of the details on your confirmation documents are correct and to bring to our attention any errors or discrepancies within 48 hours of your booking.

 

BOOKINGS AND QUOTES

Bookings can be made online at www.thebowerbyronbay.com.au or by calling The Bower Byron Bay on +61 2 66809577. Reservations are subject to availability and actual pricing at the time of booking. Quotes are valid for 24 hours only. Any quote given is an estimate only of price, which will be subject to a written advice on confirmation of booking. You agree to pay the rate for each night of your stay and any additional charges up until the time you have departed the accommodation. The accommodation may be occupied by you only for the period stated on the booking confirmation.

 

PAYMENT POLICY

Full payment is required 14 days prior to arrival. If payment is not received by the due date, The Bower Byron Bay reserves the right to cancel the booking.

 

PAYMENT OPTIONS

Payments are accepted by credit cards, Visa, MasterCard or AMEX. All payments are only accepted in AUS dollars. All credit card payments incur a 1.3% fee. Payments can be accepted via direct deposit.

 

RATES & CHARGES

Rates quoted are in Australian dollars and are subject to change at any time. Rates are inclusive of GST where applicable. Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the booking. All credit card payments will incur a 1.3% surcharge. Minimum length of stay restrictions apply to certain rates during special event periods. The price of your accommodation cannot be guaranteed until the deposit is received or if booking online full payment is required at the time of booking.

 

TRAVEL DURING COVID-19 EPIDEMIC

If government restrictions are placed on domestic travel due to the impact of Covid-19, we will provide a free change of date to your booking or provide a voucher for the full value of your booking. All other cancellations will be subject to our normal cancellation policy.

Bookings made via a third party or online travel agent ie.Booking.com, will incur additional charges due to commissions payable.

By agreeing to our terms of service you are agreeing that you are and will continue to abide by the NSW Health Department’s orders and guidelines.

 

STANDARD CANCELLATION & CHARGES

The full tariff is required 14 days prior to arrival. If you cancel your booking 14 days or more before your scheduled arrival there will be no charge*(excluding Peak & Group bookings).

 

All credit card charges will incur a 1.3% surcharge.

 

If cancelled or modified 0-14 days prior to arrival the full tariff is non-refundable.

 

*Peak Season – A non-refundable 20% deposit is required 90 days before your booking arrival date with the balance charged 14 days prior to arrival. Dates included are Easter, Christmas and New Year Holidays.

 

*Group bookings of 4 rooms or more require a non-refundable 20% deposit at the time of booking with the balance charged 30 days prior to arrival.

 

“Advanced Purchase Non Refundable” bookings will be charged the total tariff at the time of booking and is 100% non-refundable. No changes of cancellations can be made to this room rate.”

 

TRAVEL INSURANCE

Would you like to protect this booking with Cancellation Cover? We are a small family-run property and cancellations can affect us hugely.

 

We strongly recommend you purchase comprehensive travel insurance at the time of booking. We suggest that the policy should include, but not be limited to, the reimbursement of any monies paid in the event the travel is canceled; loss or damage to personal baggage and loss of money and medical expenses.

SCHOOLIES

We do not accept schoolies bookings. During the schoolies period we require a minimum check-in age of 21 with photo ID to be provided on arrival.

PHOTOSHOOTS

No photoshoots unless prior approval has been confirmed with Bower Management.

 

CHILDREN’S PRICES

Children’s prices for accommodation are included in the standard tariff rates and refer to children using existing bedding. Please note that not all room types are child friendly.

 

NUMBER OF GUESTS

At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is sought and given by management. The use of extra beds other than the number booked will attract an additional tariff. Any persons exceeding the maximum occupancy of the property will be considered trespassers and will be evicted.)

 

CHECK IN & CHECK OUT

Standard check in time is 2.00 pm on the day of arrival and the room is to be vacated by 10.00 am on the day of departure. An additional fee may be charged if you do not check out by 10.00 am. Early arrivals and late check outs are at the discretion of Management and must be requested at the time of booking. Whilst every effort will be made to accommodate early arrivals and late departures, the only way to absolutely ensure early check-in or late check-out is to book an extra night or half day where availability permits. Half day rates are charged at 50% of the nightly tariff and will extend the check out time until 2:00 pm and allow an early check in from 10:00 am.

 

CLEANING

Extra cleaning and linen change can be arranged during your stay for an additional charge, at a cost to you. Please contact management for further details. On departure, your room is to be left in a clean and tidy state. If excessive cleaning is required an additional cleaning cost of $150 will be deducted from your deposit or credit card. 

 

DAMAGES 

We reserve the right to charge the lead guest for any damages caused through the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimise damage and associated costs.

LOST BIKES

We have a fleet of Lekker bikes and bike locks available for you to borrow at our compliments. Please take proper care to ensure the bikes are locked at all times if not in use. Any lost bike will incur a fee of $500. 

 

SMOKING

Smoking inside any rooms is strictly prohibited. If there is any evidence of smoking inside rooms you will be charged an additional $500 for a specialised clean to eliminate odours. Please ensure doors and windows are closed if smoking near rooms

 

PETS

No pets are permitted.

 

PERSONAL BELONGINGS

You acknowledge that we do not cover your personal belongings under our insurance policy and therefore take no responsibility for any loss or damage of the occupant’s personal property left on the premises and agree that you will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred.

 

LOST PROPERTY

Should we recover your lost property we request that you please send a paid self addressed envelope so we can post it back to you. Note, we only hold items for 3 months. After that period items will either be donated or disposed of.

 

CAR PARKING

Allocated parking is provided for guests rooms. The Bower is not liable for any loss or damage to a vehicle nor to any property or effects of any persons using the car park, nor for any personal injury suffered by them howsoever caused whether from negligence of the Bower.

BEHAVIOUR

Parties or gatherings are strictly prohibited unless prior arrangements have been made with Management. Disturbance to other Bower guests and neighbours including excessive noise and music is prohibited and may result in eviction without refund. If a noise complaint is received a first warning will be given, if a second complaint is received this will result in immediate eviction with no refund.

 

SWIMMING POOL POLICIES

  • Open 8am – 7pm daily
  • All pool areas are exclusively for registered hotel guests only.
  • There is no lifeguard on duty swimming is at your own risk.
  • Children under the age of 12 must be accompanied by an adult at all times.
  • No smoking or e-cigarettes allowed in pool area.
  • For health and safety, swim nappies are required for children under 3. Parents will be liable should the pool be forced to close and be drained due to negligence in supplying proper nappies to prevent pool accidents.
  • Please do not ‘reserve our pool chairs’ for extended periods.
  • Diving is not permitted as the pool depth varies.
  • No glass allowed in pool area. We can supply plastic wine glasses for use in the pool area.
  • No outside pool floats are permitted. We have a selection of blow-up chairs and lounges for you to relax in.
  • Music allowed with the use of personal headphones only – no amplified music of any kind.
  • Think safely, no rough play, diving, running, pushing at the pool.
  • Any injuries should be reported immediately to Bower reception.
  • Use the bathrooms provided, not the pool. There is a nearby amenities block & a gorgeous outside hot shower for rinsing off.
  • The Bower reserves the right to refuse access & service to the pool area.
  • Guests must comply with all pool policies. Violations could result in being asked to leave the pool area or The Bower premises.

 

BREAKAGES AND DAMAGES

Damages or breakages of furniture or furnishings must be reported to Management immediately. Breakages or damages to the property and all communal or external areas that are caused by any guest and/or a guest’s visitor will be charged and recouped in full from the guest’s credit card or deducted from the guest’s refundable deposit. Excess cleaning required on departure or replacement of items removed from the accommodation will be charged to the guest’s credit card. Furniture, fixtures and fittings are not to be altered or moved between rooms or properties. There will be a charge incurred if furniture is not returned to its original location.

 

AFTER-HOURS CALL OUT FEES & LOSS OF KEYS

If security has to be called out to The Bower (out of reception hours) for a lost key; noise complaints or anything else that there is an $100.00 security call-out fee that will be charged to their credit card.

 

Loss of keys will incur a further $90.00 replacement charge.

 

COMMERCIAL USE

The property are not to be used for commercial use.

 

LIABILITIES

You acknowledge that we do not accept liability for any injury, damage, loss, additional expenses and disruptions due to electrical storms or other acts of God caused directly or indirectly by events, which are beyond our control and agree not to make any claim in relation thereto.

 

NO TENANCY

You agree that regardless of your length of stay in there is no tenancy or other rights created under any Landlord and Tenant laws and there are no such laws that apply to your stay.

 

CHANGES BEYOND OUR CONTROL

Compensation will not apply if a significant change is made for reasons beyond our control. These include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type; closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, act of government or public authorities or other circumstances amounting to force majeure and/or Acts of God.

 

BREACH OF TERMS AND CONDITIONS

You agree that, should you or your guests breach any of the terms and conditions:
You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your credit card or apply your refundable deposit in payment of that loss or damage and we may evict you and your guests without notice

 

The Bower x James Lane Giveaway Terms & Conditions

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2. The Promoter is The Bower Byron Bay (ACN 642 486 664) of 28 Bangalow Road, Byron Bay 2481.

3. Entry is open to all residents of Australia who are 18 years of age or over. However, employees and their immediate families of The Bower Byron Bay and James Lane and their associated agencies and companies are not eligible to enter.

4. The competition commences on 1/09/24 and closes 11:59pm AEST on 30/09/24.

5. To enter, participants must go to either instagram.com/thebower.byronbay or instagram.com/jameslanedesign: 1.) Follow @thebower.byronbay and @jameslanedesign on Instagram, 2) Like and save the giveaway post 3) Tag two friends in the comments of the giveaway post, and 4) Complete the competition entry form, including subscribing to receive email marketing and SMS alerts from The Bower Byron Bay and James Lane.

6. Illegible, incomprehensible and incomplete entries will be deemed invalid.

7. The Promoter reserves the right to request winners to provide proof of identity and proof of valid email address and proof of valid phone number for verification. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

8. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry are of a type described in this clause.

9. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason

10. Any entry that is made on behalf of an Entrant by a third party will be invalid.

11. The prize includes: 1 x 2-night stay at The Bower in the Queen Room, valued at up to $800, plus 1 x James Lane Bon Coffee Table in the winner’s choice of either Black or White Wash, valued at $899.

12. Total maximum prize value is $1,699.00 (including GST).

13. The prize is not transferable or exchangeable, nor is the prize redeemable for cash. The prize does not include airfares, transfers or any other expenses not outlined in the Prize.

14. The Bon Coffee Table Prize includes shipping to metro areas only. All other expenses become the responsibility of the winner. No prohibited prizes will be given away. It is the responsibility of the winner to ensure the prize can fit in their home, including passing through common areas. If the prize cannot be delivered due to size restrictions, the prize will be forfeited and a new winner selected.
15. The Bower 2-Night Stay Prize booking date must be agreed upon with The Bower in accordance with their policy. Excludes peak season. Must be redeemed within 12 months from prize draw. Booking subject to availability.
16. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

17. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

18. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

19. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

20. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize. The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

21. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

22. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

23. There will be one prize winner chosen from all valid entries. The draw will take place at The Bower Byron Bay’s Office on 2 October 2024. The winner will be contacted directly via email by end of day 2 October 2024. The winner’s name will be published on The Bower Instagram account on 3 October 2024. If the prize remains unclaimed by 16 October 2024, a redraw will be conducted on 18 October 2024, and a new winner will be selected.

24. The prize will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

25. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

26. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.

27. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

28. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

29. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

30. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

31. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

32. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. The information will be used for the purposes specified in paragraphs 19, 20, 38 and 39 (and any other anticipated purposes) without the need to obtain further consent. Entry is conditional on providing this personal information. The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at thebowerbyronbay.com.au/bower-byron-bay-privacy-policy/. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. By entering the promotion entrants consent to the provision of their personal information on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.

33. By entering this competition, entrants agree to receive marketing emails and text messages from The Bower Byron Bay and James Lane. Entrants may unsubscribe from these emails and text notifications at any stage by following the instructions contained in the footer of the marketing emails and text messages.
